DEQ seeks comment on proposed settlement action with city of Jerome

BOISE—The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with the city of Jerome wastewater treatment plant in response to its failure to submit a complete pretreatment program for approval as required under 40 CFR 403.

DEQ prepared a compliance agreement schedule directing the city to complete a local limits evaluation; update its sewer use ordinance, program implementation procedures manual, and enforcement response plan; and provide an outline of the funding and resources required to implement the pretreatment program.

Upon program approval, the city must implement the approved pretreatment program and submit a local limits sampling plan, continue to collect local limits data according to the approved sampling plan, and submit an annual report to DEQ.

Written comments on the proposed settlement action will be accepted through August 27, 2020, at 5 p.m. MDT.

The proposed settlement may be amended or adjusted in the future, in which case DEQ may provide for additional public comment depending on the significance of the changes.
