Draft NPDES 401 Certification - Hecla Limited Lucky Friday Mine

DEQ is seeking comment on a draft modified 401 water quality certification for National Pollutant Discharge Elimination System (NPDES) EPA permit no. ID0000175 for the Hecla Limited Lucky Friday Mine near Mullan, ID. This action would authorize the discharge of treated wastewater from the facility at three outfalls on the South Fork Coeur d’Alene River.
This certification was originally issued on June 3rd, 2019. The Permittee appealed the original water quality certification on July 26, 2019, and subsequently settled that appeal with DEQ (view right). Under the settlement, DEQ agreed to issue a modified water quality certification subject to public notice and comment. DEQ now seeks comment on the proposed modifications to the certification.
Please note: Only the certification conditions subject to modification are reopened for public comment. Therefore, DEQ is only accepting comments on the following proposed modifications to the certification:
- Amendments to the Compliance Schedule, including interim Copper limits for Outfall 003 (Compliance Schedule, 11-13)
- Identification of Conditions that can be made less stringent in the NPDES Discharge Permit (Permit Conditions That Can Be Made Less Stringent, 9-11)
Based on our review of the permit and fact sheet, DEQ proposes to certify that if the permittee complies with the terms and conditions imposed by the permit along with the conditions set forth in this water quality certification, then there is reasonable assurance the discharge will comply with the applicable requirements of the Clean Water Act, the Idaho water quality standards, and other appropriate water quality requirements of state law.
