DEQ seeks comment on a proposed settlement action with K-M Enterprises of Idaho, LLC

Accepting comments from July 15, 2024, through August 14, 2024.

The Idaho Department of Environmental Quality (DEQ) seeks public comment on a proposed settlement action with K-M Enterprises of Idaho, LLC regarding its University Park construction site in Sandpoint, Idaho.

DEQ alleges that on August 24, 2023, K-M Enterprises of Idaho, LLC failed to comply with all applicable conditions of its Idaho Pollutant Discharge Elimination System (IPDES) 2022 stormwater construction general permit IDR1002P3. DEQ prepared an expedited settlement agreement and consent order directing K-M Enterprises of Idaho, LLC to resolve the violations and either pay a civil penalty or request a compliance conference. K-M Enterprises of Idaho, LLC has resolved the violations, made payment in full for the civil penalty of $4,285, and signed the consent order.

In compliance with Idaho Code 39-108(9) and the “Idaho Pollutant Discharge Elimination System Rules” (IDAPA 58.01.25.500.04.), DEQ is publishing the proposed settlement action for public comment.

The proposed settlement action is available for review on DEQ’s website and at DEQ’s State Office (1410 North Hilton Street). Written comments will be accepted through August 14, 2024, at 5 p.m. MST. This settlement action may be amended or adjusted in the future, in which case, DEQ may provide an additional public comment opportunity.
