DEQ seeks comment on draft 401 water quality certification for ​Nyborg driveway crossing

Accepting comments from December 11, 2024, through January 1, 2025.

BOISE – The Idaho Department of Environmental Quality (DEQ) is seeking comment on a draft water quality certification for the Nyborg driveway crossing project.

The project proposes to construct a bridge across the Little Weiser River to access property. The prefabricated steep bridge is 12 feet wide by 80 feet span. A cofferdam will be installed above the south bank to prevent working in water. The cofferdam will consist of one-ton sacks filled with native soil and plastic sheeting to separate the work area with water flows. An excavator will be used to excavate the banks and place riprap, stabilizing the abutments on both sides. All excavated material will be placed upland from the project site. Native bank material will be placed over the riprap to return the banks to their original slope. Best management practices to prevent degradation such as work occurring during low flows, silt fencing, buffers areas between the Little Weiser River and work area and biodegradable straw matting will be placed after reseeding will occur throughout the lifetime of the project. A total of 11 linear feet of permanent impacts to the streambed will occur with 1,613 of permanent impacts to wetlands. 

Based upon review of the federal ​permit​ application, readily available water quality related materials, and certification request in accordance with 40 C.F.R. §§ 121.5 (b) and (c) and 121.7 (c), DEQ, certifies that if the permittee complies with the terms and conditions imposed by the federal ​permit​ and the conditions set forth in this water quality certification, then it is reasonable for DEQ to conclude that the activity will comply with water quality requirements, including applicable requirements of the Clean Water Act §§ 301, 302, 303, 306, and 307, Idaho’s “Water Quality Standards” (IDAPA 58.01.02), and other appropriate water quality requirements of state law.
