Individual/Subsurface Sewage Disposal:  Docket No. 58-0103-2301

Rulemaking initiated in compliance with Executive Order No. 2020-01, Zero-Based Regulation (EO 2020-01), issued by Governor Little on January 16, 2020.

Status

Pending rule adopted by the Board on November 14, 2024. If approved by concurrent resolution of the Idaho Legislature, the rule will become effective on July 1, 2025, unless otherwise specified in the concurrent resolution.

Overview

DEQ initiated this rulemaking in compliance with Executive Order No. 2020-01, Zero-Based Regulation (EO 2020-01), issued by Governor Little on January 16, 2020. 

Major proposed changes to the rule include removing and replacing definitions, revising and simplifying septic tank approvals, removing specific requirements for large septic tanks, reducing setbacks to surface water, combining the cleaning of septic tanks sections into one, simplifying the permitting process for service providers, and identifying certain provisions of the Technical Guidance Manual for Individual and Subsurface Sewage Disposal Systems to be moved into the rule.

  • DEQ discovered a contradiction between original language in Section 005 and proposed language in Section 011. Subsection 005.15 has been struck and consolidated into Subsection 011.05.
  • Language clarifying the procedure for revoking a permit has been added as Subsection 012.04.
05/29/24NADEQ is not requesting comments on this draft. The next comment period will commence upon publication of the proposed rule in the June 5, 2024 Idaho Administrative Bulletin.
